1. Acceptance of Terms

By accessing or using LeadPinger ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not access or use the Service. The Service is provided by LeadPinger ("we", "our", or "us").

2. Description of Service

LeadPinger is a lead automation platform that connects Meta (Facebook/Instagram) Lead Ads with WhatsApp Business messaging. The Service allows you to automatically receive leads from Meta Lead Ad forms and send WhatsApp messages to those leads. The Service acts as an intermediary between Meta's Graph API and WhatsApp Business Cloud API on your behalf.

3. Account Registration

To use the Service, you must create an account with a valid email address and password. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account.

You must be at least 18 years old and have the legal authority to enter into these terms. If you are using the Service on behalf of a business, you represent that you have the authority to bind that business to these terms.

4. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these terms. You agree not to:

— Send spam, unsolicited messages, or messages that violate WhatsApp's Business Policy

— Use the Service to harass, abuse, or harm others

— Attempt to gain unauthorized access to the Service or its systems

— Use the Service to collect or process data in violation of applicable privacy laws

— Resell or redistribute the Service without our written consent

5. Meta & WhatsApp Compliance

By using the Service, you acknowledge that your use of Meta Lead Ads and WhatsApp Business API is subject to Meta's terms of service, WhatsApp Business Policy, and WhatsApp Commerce Policy. You are solely responsible for ensuring your messages comply with these policies.

We are not responsible for any actions taken by Meta or WhatsApp regarding your account, including but not limited to suspension, termination, or restriction of your Meta or WhatsApp Business account.

6. Data Ownership

You retain full ownership of all lead data processed through the Service. We do not claim any ownership rights over your leads, messages, or business data. We process your data solely to provide the Service as described, in accordance with our Privacy Policy.

7. Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control (including Meta or WhatsApp API outages). We are not liable for any losses resulting from service interruptions.

8. Limitation of Liability

To the maximum extent permitted by law, LeadPinger shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the twelve months preceding the claim.

9. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. You may terminate your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately, and we will delete your data in accordance with our Privacy Policy.

10. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of material changes by updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the updated terms.
